Process & Fees

To file a trademark application in Canada, the applicant must either have used the mark in association with the goods and/or services listed in the application or have a bona fide intention to use the mark.

While it is not necessary to specify in an application which filing basis applies, it is important to confirm which applies before filing an application, as it may be necessary to support the filing basis if the application is challenged.

To complete an application, we will need:

  1. Do you want to register a word (mark) or logo (design) or both? Filing fees are separate for each.
  2. The trademark including a drawing in the case of a design mark; and
  3. A description of the goods or services.

The goods or services must be described in ordinary commercial terms. An application may be amended after filing to remove goods or services, but not to add additional goods or services.

Fees contained herein are estimates based upon fees typically incurred for routine matters. These estimated fees do not include fees for additional professional work including extensive assistance in preparing listings of goods and services, reviewing, reporting, and responding to Examiners’ Reports and/or oppositions, classifying lengthy specifications of goods and services (which will be completed on a time-spent basis or as discussed in advance), and attending to matters of an unusual or unanticipated nature, all of which are charged on a time-spent basis at our standard hourly rates.

All royalties generated through the licensing program are intended for community and campus development projects directed through Ancillary Services. The program is not intended to profit from non-commercial promotions that occur on campus. U of T divisions, authorized individuals, recognized student groups and other recognized organizations are exempt from royalties provided insignia goods are not sold for profit and adhere to the guidelines set by the University.
